Florida Car Accident FAQ

Guest post by berkmyer.com

Car accidents can often leave victims with many questions about their rights and the legal process. Here are some answers to some of the questions we frequently hear from victims who come to us for help.

Will I be Able to Recover Compensation for my Losses?

It should come as no surprise that the first question that many car accident victims ask is whether they will be able to recover compensation for their losses, as wrecks can leave people with medical expenses, vehicle repairs, an inability to work, and significant injuries that cause pain and suffering. Generally speaking, if your accident was someone else’s fault, you will be able to obtain compensation from the at-fault party an insurance company.

Do I Need to File a Lawsuit?

The answer to this question comes as a surprise to many car accident victims. Most car accident cases are resolved out of court and often before a lawsuit1 is filed. This is because liability is often conceded, which means that the only issue that needs to be resolved is how much the at-fault party will pay the victim. If liability is contested, however, there is a good chance that your case will go to trial.

How Much will it Cost to Hire a Lawyer?

Many car accident victims are concerned about the costs associated with hiring a lawyer. Fortunately for victims, almost all personal injury lawyers enter into a contingent fee2 agreement with their clients. These arrangements make any fee the lawyer receives contingent upon the outcome of the case – if the lawyer is unable to recover compensation for the client, he or she will not owe anything for legal representation. If compensation is recovered, the lawyer will take a percentage (typically a third) of the settlement or award for his or her fee.
